Texas Fruit Festival 2026 – Terms of Service and Liability Agreement

By purchasing a ticket, submitting a volunteer application, paying a volunteer deposit, or attending any portion of the Texas Fruit Festival (the “Festival”), you acknowledge that you have read, understand, and agree to the following Terms of Service (“Agreement”). Checking the acknowledgment box during checkout constitutes your electronic signature.
1. General Agreement
Attendance at the Festival is conditioned upon full acceptance of these Terms. If you do not agree to these Terms, do not purchase a ticket or attend.
2. Assumption of Risk
Participation involves inherent risks including physical activity, shared accommodations, outdoor exposure, and consumption of various foods. You voluntarily assume all risks and release Electric Dreamscape LLC, its staff, volunteers, contractors, and affiliates from liability for any injury, illness, or damages arising from participation.
3. Medical Disclaimer
The Festival and its presenters do not provide medical advice. All information shared is educational only. Always consult your licensed healthcare provider before making health decisions.
3A. No Guarantee of Outcomes
No guarantees are made regarding personal transformation, emotional benefit, health improvement, or any specific experience or result.
3B. No Reliance on Oral Statements
Only the written terms of this Agreement are binding. No verbal statements or informal conversations shall be interpreted as health guidance, promises, or guarantees.
4. Food and Dietary Disclosures
Food may contain or come into contact with allergens including nuts, seeds, soy, wheat, and others. Not all food served or available will be organic. You are solely responsible for your dietary choices and allergen management.
5. Refund and Cancellation Policy
Attendee (Regular Guest) Tickets:
• 100% refundable until March 1, 2026, minus a 3% credit card processing fee.
• After March 1, 2026, the amount paid becomes non-refundable, but may be converted into full-value credit for a future Festival if a future Festival occurs.
Volunteers:
• A $100 refundable deposit is required to register as a volunteer.
• The deposit is refundable until March 1, 2026, minus a 3% processing fee.
• After March 1, 2026, the deposit becomes non-refundable.
• Volunteers must complete 4.5 hours of service per Festival day, plus 4.5 hours on the setup day and 4.5 hours on the teardown day. Failure to complete required hours may result in forfeiture of the deposit and removal from volunteer status.
6. Conduct Policy
No drugs, alcohol, tobacco, mind-altering substances, aggression, harassment, or sexual contact is permitted.
The Festival may remove any attendee or volunteer at any time for behavior deemed unsafe, disruptive, or inappropriate, without refund.
6A. Weapons Policy
Weapons of any kind, including firearms, are not permitted anywhere on Festival grounds or Festival lodging, regardless of licensing status.
7. Lodging and Property Responsibility
Attendees staying in shared lodging (including Airbnb or similar housing) must comply with all property rules, host policies, occupancy limits, sanitary expectations, and quiet hours.
The Festival does not own or control these properties and is not responsible for conditions, safety, maintenance, interpersonal conflict, or theft.
Attendees are responsible for their belongings.
If an attendee causes damage, violation fees, cleaning fees, or fines, the attendee accepts full financial responsibility and authorizes the Festival to invoice or charge them accordingly.
7A. Pets and Service Animals
Pets and emotional support animals are not permitted.
Trained service animals performing recognized tasks for a disability are permitted and must be supervised and controlled at all times.
7B. Fire Safety and Personal Equipment
No heating devices, incense, candles, cooking equipment, or open flame is permitted in any lodging or event spaces.
Attendees are financially responsible for any damages or penalties resulting from restricted items.
8. Force Majeure
If the Festival must be modified, postponed, or canceled due to events beyond its control (including natural disasters, pandemics, venue disruption, or government restrictions), tickets will convert to future-event credit. No cash refundswill be issued.
9. Injury and First Aid
Festival staff and volunteers are not medical professionals. Limited first aid may be offered, but attendees are responsible for their own medical decisions.
10. Personal Property and Vehicles
Attendees are responsible for personal items and vehicles. The Festival assumes no liability for loss, theft, or damage.
11. Vendors and Speakers
Speakers and vendors act independently. Their views are their own. The Festival is not responsible for their statements, recommendations, or products.
12. Compliance with Venue and Law
Attendees must comply with Casa de Luz property rules and all applicable local, state, and federal laws.
13. Minors
Attendees under 18 must be accompanied by a parent or legal guardian at all times. Minors attend free. Guardians assume all liability for minors.
14. Media and Photography Consent
By attending, attendees grant permission for their likeness, voice, and image to be recorded and used for promotional purposes without compensation or time limitation.
15. Limitation of Liability
Festival liability is limited to the amount paid for attendance. No indirect, incidental, special, or consequential damages may be recovered.
16. Arbitration
All disputes shall be resolved by binding arbitration in Travis County, Texas, under the rules of the American Arbitration Association.
Class action participation is waived.
17. Governing Law
This Agreement is governed by the laws of the State of Texas, with venue in Travis County.
By checking the acknowledgment box at checkout or attending the Festival, you confirm your agreement to all terms in this document.
